This article aims to present the past and present state and future possibilities of philosophy of education as an academic discipline in Turkey as related to teacher training programs and academic studies in higher education institutions. It takes philosophy of education as consisting of the approaches that have emerged in its history. It has come to Turkey as a part of the modernization of education. It seems that during the Republican era in Turkey before World War II, mainly due to (...) the dominance of the German conception of educational studies, the pedagogy and the history of pedagogy courses and the textbooks for them, which were central to the curricula of teacher training schools, contained the subjects of philosophy of education in its continental form; and after World War II philosophy of education is mostly understood, primarily due to Turkey’s changing international relations and the spread of American influence, as the isms and the doctrines approaches as found in the USA between the 1940s and 1960s, while other approaches in the field have been less influential. The article identifies how the restructuring of the teacher training system and the curricula of Faculties of Education in 1998 was a serious blow to the discipline, since it excluded philosophy of education from the curricula of teacher preparation schools, and the flourishing discipline thus lost its hold and importance in the undergraduate programs, and then in graduate programs. But the 2006 revision of the curricula has given a kiss of life to the discipline. There are reasons to think that it can recover in the coming period. (shrink)

Both in historical debates and in recent discussions, the Guise of the Good Thesis represents a genuine dogma of rationalism in moral philosophy. Many influential commentators have maintained that Kant belongs in that camp, even that he “explicitly endorses” the Thesis. Attributing the Thesis to Kant, however, faces scarce textual support and amounts to a dubious understanding of the relationship of Kant’s moral philosophy to previous rationalist views. I suggest that, in Kant’s view, the Thesis only applies to the determination (...) of the will through the moral law. The principle that prior rationalists regarded as descriptive acquires in Kant’s terms a normative status. (shrink)

This article described three heuristics that are employed in making judgements under uncertainty: representativeness, which is usually employed when people are asked to judge the probability that an object or event A belongs to class or process B; availability of instances or scenarios, which is often employed when people are asked to assess the frequency of a class or the plausibility of a particular development; and adjustment from an anchor, which is usually employed in numerical prediction when a relevant (...) value is available. These heuristics are highly economical and usually effective, but they lead to systematic and predictable errors. A better understanding of these heuristics and of the biases to which they lead could improve judgements and decisions in situations of uncertainty. (shrink)

I issue a challenge for the view that deciding‐to‐A is rendered intentional by an intention or other pro‐attitude towards deciding. Either such an attitude cannot rationalize my deciding specifically to A for a reason I take to support doing A, or, fixing for this, cannot accommodate deciding without entertaining alternatives. If successful, the argument motivates the search for an account that does not source the intentionality of deciding in a rationalizing pro‐attitude.

The essays in this book clarify the technical, legal, ethical, and social aspects of the interaction between eHealth technologies and surveillance practices. The book starts out by presenting a theoretical framework on eHealth and surveillance, followed by an introduction to the various ideas on eHealth and surveillance explored in the subsequent chapters. Issues addressed in the chapters include privacy and data protection, social acceptance of eHealth, cost-effective and innovative healthcare, as well as the privacy aspects of employee wellness programs using (...) eHealth, the use of mobile health app data by insurance companies, advertising industry and law enforcement, and the ethics of Big Data use in healthcare. A closing chapter draws on the previous content to explore the notion that people are 'under observation', bringing together two hitherto unrelated streams of scholarship interested in observation: eHealth and surveillance studies. In short, the book represents a first essential step towards cross-fertilization and offers new insights into the legal, ethical and social significance of being 'under observation'. (shrink)

According to the thesis of the guise of the normative, all desires are associated with normative appearances or judgments. But guise of the normative theories differ sharply over the content of the normative representation, with the two main versions being the guise of reasons and the guise of the good. Chapter 6 defends the comparative thesis that the guise of reasons thesis is more promising than the guise of the good. The central idea is that observations from the theory of (...) content determination can be used in order to constrain possible theories of the representational contents associated with desire. The authors argue that the initially most promising versions of the guise of the good fail to meet these constraints, and then explain the steep challenge confronting any who wish to craft a new guise of the good theory which meets the constraints while also preserving the initial motivations for adopting any guise of the normative theory at all. But a simple version of the guise of reasons not only avoids the troubles besetting the guise of the good but proceeds immediately from a deep diagnosis of the source of its difficulties. (shrink)

As Hume famously claimed, we are nowhere more free than in our imagination. While this feature of imagination suggests that imagination has a crucial role to play in modal epistemology, it also suggests that imagining cannot provide us with any non-modal knowledge about the world in which we live. This chapter rejects this latter suggestion. Instead it offers an account of “imagining under constraints,” providing a framework for showing when and how an imaginative project can play a justificatory role (...) with respect to our beliefs about the world. That we can be free in our imaginings does not show that they must proceed unfettered; as is argued, our ability to constrain our imaginings in light of facts about the world enables us to learn from them. The important upshot is that imagination has considerably more epistemic significance than previously thought. (shrink)

In a response to two essays by Jan Zwicky on “lyric philosophy,” this piece questions whether there are positions that cannot be fully articulated in conventional, linear prose without contradiction and, if so, whether or in what sense they can be considered philosophical positions. Zwicky's experimental deployment of polyphonic textual structures to render her conception of a patterned and resonant whole is, Hobbs argues, part of a tradition, going back to ancient Greece, of radical philosophers struggling to express themselves without (...) pragmatic self-refutation. In particular, Hobbs explores Zwicky's acknowledged debt to the paradoxes and aphorisms of Heraclitus, in whose thought the “backward-turning connection” of the lyre plays a central role. Hobbs suggests that, although both Heraclitus and Zwicky use language to stimulate profound changes in the reader's perception, understanding, and ethical outlook, there are important divergences in their projects: Zwicky assumes that humans have access to the resonant whole, while Heraclitus chooses to write in paradoxes partly in order to highlight the inevitable limitations of mortal knowledge of the Logos, which is known fully only to god. Zwicky's depiction of a generalized “analytic” philosopher may also be thought oversimplified: few analytic philosophers, if any, would claim that meaning can only be “linguistic in form,” and it is unclear what is meant by “technocratically acceptable prose.” Nevertheless, Zwicky's claim that the practice of philosophy is “better understood as an exercise of attention disciplined by discernment of the live, metaphorical relation between things and the resonant structure of the world” is an important one, and the challenges that it poses to our conceptions of what philosophy is and how to write it are not ones that should be ignored. This book explores the nature, value, and role of hope in human life under conditions of oppression. Oppression is often a threat and damage to hope, yet many members of oppressed groups, including prominent activists pursuing a more just world, find hope valuable and even essential to their personal and political lives. This book offers a unique evaluative framework for hope that captures the intrinsic value of hope for many of us, the rationality and morality of hope, and ultimately (...) how we can hope well in the non-ideal world we share. It develops an account of the relationship between hope and anger about oppression and argues that anger tends to be accompanied by hopes for repair. When people’s hopes for repair are not realized, as is often the case for those who are oppressed, anger can evolve into bitterness: a form of unresolved anger involving a loss of hope that injustice will be sufficiently acknowledged and addressed. But even when all hope might seem lost or out of reach, faith can enable resilience in the face of oppression. Spiritual faith, faith in humanity, and moral faith are part of what motivates people to join in solidarity against injustice, through which hope can be recovered collectively. Joining with others who share one’s experiences or commitments for a better world, and uniting with them in collective action, can restore and strengthen hope for the future when hope might otherwise be lost. Coercion by the recipient of consent renders that consent invalid. But what about when the coercive force comes from a third party, not from the person to whom consent would be proffered? In this paper I analyze how threats from a third party affect consent. I argue that, as with other cases of coercion, we should distinguish threats that render consent invalid from threats whose force is too weak to invalidate consent and threats that are legitimate. Illegitimate controlling third party (...) threats render consent invalid just as they do in two party cases. However, knowing that the consent is invalid is not sufficient to tell the recipient of consent what she may or should do. I argue that when presented with a token of consent from someone whom she thinks is experiencing an illegitimate controlling threat, the recipient may act on that token if and only if doing so represents a reasonable joint decision for her and the victim of coercion. The appropriate action for someone faced with third party coercion therefore depends on the other options open to her and those open to the victim of coercion. (shrink)

Despite increasing concern over the extent of physician-industry relationships, physicians usually fail to recognize the nature and impact of subconscious and unintentional biases on therapeutic decision-making. Pharmaceutical and medical device companies, however, routinely demonstrate their knowledge of social psychology processes on behavior and apply these principles to their marketing. (...) To illustrate how pharmaceutical marketing strategies use psychological techniques to promote targeted therapies, we draw on the relevant social psychology literature on conflicts of interest and on the six principles of influence articulated by the eminent social psychologist Robert Cialdini. Hospitals, professional organizations, medical educators, and other stakeholders must also draw on social psychology to respond effectively to commercial activities that compromise good medical practice. Pharmaceutical and medical device companies apply social psychology to influence physicians' prescribing behavior and decision making. Physicians fail to recognize their vulnerability to commercial influences due to self-serving bias, rationalization, and cognitive dissonance. Professionalism offers little protection; even the most conscious and genuine commitment to ethical behavior cannot eliminate unintentional, subconscious bias. Six principles of influence — reciprocation, commitment, social proof, liking, authority, and scarcity — are key to the industry's routine marketing strategies, which rely on the illusion that the (...) industry is a generous avuncular partner to physicians. In order to resist industry influence, physicians must accept that they are vulnerable to subconscious bias and have both the motivation and means to resist industry influence. A culture in which accepting industry gifts engenders shame rather than gratitude will reduce conflicts of interest. If greater academic prestige accrues to distant rather than close relationships with industry, then a new social norm may emerge that promotes patient care and scientific integrity. In addition to educating faculty and students about the social psychology underlying sophisticated but potentially manipulative marketing and about how to resist it, academic medical institutions should develop strong organizational policies to counteract the medical profession's improper dependence on industry. The ‘question under discussion’ (or ‘QUD’) framework is a pragmatic framework that draws on work in the semantics of questions to provide an appealing account of a range of pragmatic phenomena, including the use of prosodic focus in English and restrictions on acceptable discourse moves (Roberts 1996). More recently, however, a number of proposals have attempted to use the framework to help to settle issues at the semantics/pragmatics boundary, fixing the truth-conditions of what is said by a speaker (which (...) many theorists take to be a semantic matter). In this discussion piece, we suggest that this kind of putative extension of the work to be done by the QUD framework is illegitimate, as the framework ultimately seems to depend on a prior grip on semantic content. The question whether two things can be in the same place at the same time is an ambiguous one. At least three distinct questions could be meant: Can two things simpliciter be in the same place at the same time? Can two things of the same kind be in the same place at the same time? Can two substances of the same kind be in the same place at the same time? The answers to these questions vary. This response defends the view that human metacognition results from us turning our mindreading capacities upon ourselves, and that our access to our own propositional attitudes is through interpretation rather than introspection. Relevant evidence is considered, including that deriving from studies of childhood development and other animal species. Also discussed are data suggesting dissociations between metacognitive and mindreading capacities, especially in autism and schizophrenia.

Policymakers who seek to make scientifically informed decisions are constantly confronted by scientific uncertainty and expert disagreement. This thesis asks: how can policymakers rationally respond to expert disagreement and scientific uncertainty? This is a work of non-ideal theory, which applies formal philosophical tools developed by ideal theorists to more realistic cases of policymaking under scientific uncertainty. I start with Bayesian approaches to expert testimony and the problem of expert disagreement, arguing that two popular approaches— supra-Bayesianism and the standard model (...) of expert deference—are insufficient. I develop a novel model of expert deference and show how it can deal with many of these problems raised for them. I then turn to opinion pooling, a popular method for dealing with disagreement. I show that various theoretical motivations for pooling functions are irrelevant to realistic policymaking cases. This leads to a cautious recommendation of linear pooling. However, I then show that any pooling method relies on value judgements, that are hidden in the selection of the scoring rule. My focus then narrows to a more specific case of scientific uncertainty: multiple models of the same system. I introduce a particular case study involving hurricane models developed to support insurance decision-making. I recapitulate my analysis of opinion pooling in the context of model ensembles, confirming that my hesitations apply. This motivates a shift of perspective, to viewing the problem as a decision theoretic one. I rework a recently developed ambiguity theory, called the confidence approach, to take input from model ensembles. I show how it facilitates the resolution of the policymaker’s problem in a way that avoids the issues encountered in previous chapters. This concludes my main study of the problem of expert disagreement. In the final chapter, I turn to methodological reflection. I argue that philosophers who employ the mathematical methods of the prior chapters are modelling. Employing results from the philosophy of scientific models, I develop the theory of normative modelling. I argue that it has important methodological conclusions for the practice of formal epistemology, ruling out popular moves such as searching for counterexamples. (shrink)

Why does female under- representation emerge during undergraduate education? At the University of Sydney, we surveyed students before and after their first philosophy course. We failed to find any evidence that this course disproportionately discouraged female students from continuing in philosophy relative to male students. Instead, we found evidence of an interaction effect between gender and existing attitudes about philosophy coming into tertiary education that appears at least partially responsible for this poor retention. At the first lecture, disproportionately few (...) female students intended to major. Further, at the first lecture, female students were less interested in philosophy, were less self-confident about philosophy, and were less able to imagine themselves as philosophers. Similarly, female students predicted they would feel more uncomfortable in philosophy classes than male students did. Further study with a control is warranted to determine whether this interaction effect is peculiar to philosophy, or whether it is indicative of a more general gendered trend amongst first year undergraduate students. Following Darcy’s concession in 1901, Britain began oil exploration in the southwest of Iran. In 1908, economic oil was discovered, and the Anglo- Persian Oil Company (APOC) was established. This company from its establishment was under the influence of the British Government, to extend that, Britain became its major shareholder in 1917 which continued until the nationalization of Iran’s oil in 1951. In the meantime, the concession and following agreements prepared an almost autonomous status for the company. Generally, Iran (...) had never been a British colony, however; this status had evidence of colonialism and let the company build the artificial environment in Iran’s southwestern, based on its attitudes and values, as well as hierarchical structure, racial-class segregation, and closed society, which experts consider it as a type of social engineering. According to this, the building formed by the company could manifest the upstream ideas, specifically in towns that were completely shaped by it. Therefore, Masjed Soleyman and Abadan, the two main company towns of the British-owned Anglo-Persian Oil Company, which were quite isolated from other parts of Iran, could be suitable platforms for displaying the company’s attitudes and values. Therefore, this research by interpretive-historical methodology, based on both primary and secondary sources from desk research and archival research, investigates the manifestation of the company’s attitudes and values in its quiet a half-century (1901-1951) building in Masjed Soleyman and Abadan, in five periods. These periods were shaped based on the most important happens including periods of exploration (1901-1908), formation (1908-1917), primary development (1917-1933), secondary development (1933-1939), and leading to the nationalization of oil (1939- 1951). In the first period, there is no evidence of architecture or urbanism, in the second and third periods, architecture, specifically bungalows appeared company values and in the fourth and fifth periods, urbanism especially, garden cities represented company values. Decisions where there is not enough information for a well-informed decision due to unidentified consequences, options, or undetermined demarcation of the decision problem are called decisions under great uncertainty. This paper argues that public policy decisions on _how_ and _if_ to implement decision-making processes based on machine learning and AI for public use are such decisions. Decisions on public policy on AI are uncertain due to three features specific to the current landscape of AI, namely (i) the vagueness of (...) the definition of AI, (ii) uncertain outcomes of AI implementations and (iii) pacing problems. Given that many potential applications of AI in the public sector concern functions central to the public sphere, decisions on the implementation of such applications are particularly sensitive. Therefore, it is suggested that public policy-makers and decision-makers in the public sector can adopt strategies from the argumentative approach in decision theory to mitigate the established great uncertainty. The global Covid-19 pandemic has resulted in social and economic disruption unprecedented in the modern era. Many countries have introduced severe measures to contain the virus, including travel restrictions, public event bans, non-essential business closures and remote work policies. While digital technologies help governments and organizations to enforce protection measures, such as contact tracing, their rushed deployment and adoption also raises profound concerns about surveillance, privacy and data protection. This article presents two critical cases on digital surveillance technologies implemented during (...) the Covid-19 pandemic and delineates the privacy implications thereof. We explain the contextual nature of privacy trade-offs during a pandemic and explore how regulatory and technical responses are needed to protect privacy in such circumstances. By providing a multi-disciplinary conversation on the value of privacy and data protection during a global pandemic, this article reflects on the implications digital solutions have for the future and raises the question of whether there is a way to have expedited privacy assessments that could anticipate and help mitigate adverse privacy implications these may have on society. Choice often proceeds in two stages: We construct a shortlist on the basis of limited and uncertain information about the options and then reduce this uncertainty by examining the shortlist in greater detail. The goal is to do well when making a final choice from the option set. I argue that we cannot realise this goal by constructing a ranking over the options at shortlisting stage which determines of each option whether it is more or less worthy of being included (...) in a shortlist. This is relevant to the 2010 UK Equality Act. The Act requires that shortlists be constructed on grounds of candidate rankings and affirmative action is only permissible for equally qualified candidates. This is misguided: Shortlisting candidates with lower expected qualifications but higher variance may raise the chance of finding an exceptionally strong candidate. If it does, then shortlisting such candidates would make eminent business sense and there is nothing unfair about it. This observation opens up room for including more underrepresented candidates with protected characteristics, as they are more likely to display greater variance in the selector’s credence functions at shortlisting stage. Panpsychism is an eminently sensible view of the world and its relation to mind. If God is a metaphysician, and regardless of the actual truth or falsity of panpsychism, it is certain that he regards the theory as an honest and elegant competitor on the field of ontologies. And if God didn’t create a panpsychist world, then there’s a fair chance that he wishes he had done so, or will do next time around. The difficulties panpsychism faces, then, are not (...) metaphysical ones. They are, instead, difficulties of understanding, and of acceptance by philosophers. The main difficulty of this sort the theory faces is that its ontology – with consciousness in some sense at the heart of all that exists1 – is deemed too bizarre, frankly, too humano-centric to be taken seriously. Why should anyone think that consciousness, widely held to be the preserve only of ourselves, plus the most recently evolved organisms, infuses the basement level of all existence? Such a thought seems to many – especially, to scientifically scrupled philosophers of mind – a narcissistic (or at best hopelessly anti-realist) folly, which doesn’t even deserve its day in court. This book is a study of comparative philosophy and theology. The themes are the critical issues arising from the modern interpretation of Confucian doctrine as they confront the Christian beliefs of the nineteenth and twentieth centuries.

Argumentation is the offspring of logic, dialectic, and rhetoric. Differences among them are matters more of degree than of kind, but each reflects basic underlying assumptions. This essay explicates five key assumptions of rhetorical approaches to argumentation: audience assent is the ultimate measure of an argument’s success or failure; argumentation takes place within a context of uncertainty, both about the subject of the dispute and about the process for conducting the dispute; arguers function as restrained partisans and accept risks that (...) follow from such a status; despite its seemingly adversarial nature, argumentation is fundamentally cooperative, pursuing the shared goal of making the best decision; and argumentation is grounded in the situational context of particular cases. Against content theories of slurs, according to which slurs have some kind of derogatory content, Anderson and Lepore have objected that they cannot explain that even slurs under quotation can cause offense. If slurs had some kind of derogatory content, the argument goes, quotation would render this content inert and, thus, quoted slurs should not be offensive. Following this, Anderson and Lepore propose that slurs are offensive because they are prohibited words. In this paper, we will show that, pace (...) Anderson and Lepore, content theories of slurs do provide an explanation of the fact that quoted slurs can cause offense: even under quotation, the explanation goes, the derogatory content of a slur can still be psychologically efficacious. We will go one step further by pointing out that offensiveness is not the only function of slurs, but that slurs can also be used to create and reinforce negative attitudes towards the target group. While content theories can easily explain this by referring to some kind of derogatory content, Anderson and Lepore’s prohibitionism will lack a satisfactory explanation of this second function of slurs. Concluding, we will argue that, unlike uses of slurs, uses of quoted slurs normally do not derogate the target group. This will again speak in favor of content theories. Accordingly, uses of quoted slurs are not derogatory because quotation renders the derogatory content inert. Hence, rather than speaking against content theories, quoted slurs speak in their favor. Citizenship under Fire examines the relationship among civic education, the culture of war, and the quest for peace. Drawing on examples from Israel and the United States, Sigal Ben-Porath seeks to understand how ideas about citizenship change when a country is at war, and what educators can do to prevent some of the most harmful of these changes.Perhaps the most worrisome one, Ben-Porath contends, is a growing emphasis in schools and elsewhere on social conformity, on tendentious teaching of history, (...) and on drawing stark distinctions between them and us. As she writes, "The varying characteristics of citizenship in times of war and peace add up to a distinction between belligerent citizenship, which is typical of democracies in wartime, and the liberal democratic citizenship that is characteristic of more peaceful democracies."Ben-Porath examines how various theories of education--principally peace education, feminist education, and multicultural education--speak to the distinctive challenges of wartime. She argues that none of these theories are satisfactory on their own theoretical terms or would translate easily into practice. In the final chapter, she lays out her own alternative theory--"expansive education"--which she believes holds out more promise of widening the circles of participation in schools, extending the scope of permissible debate, and diversifying the questions asked about the opinions voiced. We live in a liquid new world driven by incessant change. Our reality is constantly shaped by new forms of non-linear individualism, which is expressed in countless factions, networks, tribes and alliances. Social systems do not maintain their shape for very long, because they decompose and melt faster than the time it takes to cast them, according to the sociologist Zygmunt Bauman. Religious institutions that do not come to terms with these rapid rates of change soon find themselves trapped in (...) a so-called parallel universe, with hardly any influence on society. In order to embrace our fluid new reality with its numerous open systems and ever-increasing levels of complexity, ekerk understands herself as a movement of Jesus followers whose tribal identity is shaped around his teachings on the Kingdom of God, and which is reflected in the values of relationality and generosity. We have ‘tribal habitats’ in various digital and physical spaces. Under the radar of institutionalised church and academia, but also as their ally in a somewhat subversive manner, ekerk facilitates the spreading of the good news of Jesus in decentralised but very real ways. ekerkalso runs a large generosity ministry, as well as various seminars, meetings and growth programmes such as DieGang/TheGang to invest in young Christian leaders. Drawing on the perspective of causal reasoning and the social cognitive theory of moral thought and action, this study explores the mechanisms underlying the association between exposure to exploitative leadership and employee workplace deviance. The results of a time-lagged survey conducted in China reveal that exposure to exploitative leadership can evoke a moral justification process that leads to increased employee organizational and interpersonal deviance. A tendency toward hostile attribution bias reinforces the direct link between exploitative leadership and moral justification and (...) the indirect effects of exploitative leadership on employee organizational and interpersonal deviance, via moral justification. The theoretical and practical implications of this study are discussed and potential directions for future studies are proposed. (shrink)

In solving judgment aggregation problems, groups often face constraints. Many decision problems can be modelled in terms the acceptance or rejection of certain propositions in a language, and constraints as propositions that the decisions should be consistent with. For example, court judgments in breach-of-contract cases should be consistent with the constraint that action and obligation are necessary and sufficient for liability; judgments on how to rank several options in an order of preference with the constraint of transitivity; and judgments on (...) budget items with budgetary constraints. Often more or less demanding constraints on decisions are imaginable. For instance, in preference ranking problems, the transitivity constraint is often contrasted with the weaker acyclicity constraint. In this paper, we make constraints explicit in judgment aggregation by relativizing the rationality conditions of consistency and deductive closure to a constraint set, whose variation yields more or less strong notions of rationality. We review several general results on judgment aggregation in light of such constraints. (shrink)

This paper considers the argument that if the ban on doping in sports was abolished it would be possible to have doping under medical control, i.e. open doping, prescribed by doctors with collection of reliable information about effects and side-effects. A game-theoretic argument is developed showing that this positive scenario is very unlikely to be instantiated given reasonable assumptions about the motivation of sportspersons and sports doctors. There is a curious phenomenon where people from marginalized populations are taken to be arrogant when they show no signs of superiority. In effect, their actions are misconstrued, and their attitudes are rendered unintelligible. Given that arrogance is standardly taken to be a flaw in one’s moral character, understanding such misattributions should give us insight into the affective marginalization many people face. This talk aims to give a thorough exploration of arrogance under oppression. I argue that arrogance is a (...) kind of self-preoccupation that involves projecting one’s values, goals, and concerns onto others as if they were objective values, goals, and concerns. When the affectively marginalized communicate their self-respect through things like protest, people mistake that self-respect as self-preoccupation given how the affectively marginalized are constructed. Furthermore, given how affective marginalization not only inhibits how the marginalized are understood by others, but inhibits their own affective lives, I argue that taking up an arrogant attitude is not always morally vicious, but can be a beautiful form of political resistance but all things considered good. ABSTRACTConsulting Heidegger's other texts composed during 1936–1942, this article employs a principle of charity and constructs a consistent discourse about an inceptual negativity Heidegger articulates through a confrontation with Hegel in GA 68. Heidegger deliberately differentiates his use of denial that bears Being-historical significance from Hegel's Negation that allegedly aims at synthesis or elevation as a dialectical movement. Being unsatisfied with his approach that remains entangled with metaphysics in the Contributions, Heidegger attempts to transform the question of the Nothing from (...) a subsidiary question to Beyng to an abyssal question. One needs to go under toward the Nothing in its concealed, conjoined, and most intimate relation to Beyng. The movement of going under is fundamentally significant for transitions that could occur from out of the history of Beyng. This paper focuses on consent and third-party coercion, viz. cases in which a person consents to another person performing a certain act because a third party coerced her into doing so. I argue that, in these cases, the validity of consent depends on the behavior of the recipient of consent rather than the third party’s coercion taken separately, and I will specify the conditions under which consent is invalid. My view, which is a novel version of what I call (...) a Recipient-Focus-View, holds that coercion invalidates consent only if consent was ‘obtained by’ coercion, but not if consent was ‘merely motivated by’ coercion. I explain and support my view on the basis that it best reconciles an unnoticed tension between two fundamental principles in the debate on consent and that it can deal with cases that undermine other Recipient-Focus-Views. In a recent paper in the Yale Law Journal, Malcolm Thorburn argued that to enjoy a justificatory defence in the criminal law is to have a normative power that is exercised in the circumstances which give rise to the justification. He also argued that where such powers are conferred on private citizens, those citizens should be understood as acting as public officials pro tempore when they exercise them. In this extended reply, I resist both propositions and reply to some of (...) the criticisms that Thorburn makes of my own rival views. I also take the opportunity to explore, philosophically, some of the criminal law relating to consent, self-defence and arrest, and to discuss the connections between the debate over the nature of criminal-law justifications and the debate over the nature of law.
